The September 2022 Visa Bulletin has been released, detailing priority dates for green card applicants for next month. Unfortunately, there was no movement in any priority dates across the board for September’s visa bulletin. A partial explanation of why has been shared by the USCIS, which we will analyze deeper down below.

September 2022 Visa Bulletin Analysis

In our September 2022 Visa Bulletin Predictions article, we were predicting a small amount of movement for India EB2 and did expect little or no movement for EB3. In a surprising turn of events, there is no movement at all for all categories across the board in the September 2022 Visa Bulletin release. Of course, this is worrisome for those patiently waiting for their priority date to arrive. Why was there no movement, and does this mean that a retrogression in on the horizon? In the September 2022 Visa Bulletin, the USCIS added a note regarding the availability of employment-based visas. This note explained that there has been a steady increase in demand for employment-based visas during 2022, and as a result, most employment-based preference category limits and/or the overall employment-based preference limit is expected to be reached in September 2022. If the employment-based preference category visa limit is reached next month, the USCIS will need to make the employment-based visa category “unavailable”, meaning that no further requests for numbers would be honored. October 2022 Visa Bulletin Predictions

Due to the lack of movement in the September 2022 Visa Bulletin, and the notes from USCIS regarding the limit nearing its reach for employment-based visas in September, October 2022 may not yield the results that many are hoping for. As of right now, we would predict that we do not see any movement in India EB2 in October, and will possibly see a retrogression for India EB3.
